Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CheerTix website, mobile experiences, and ticketing services (collectively, the "Service") operated by CheerTix ("CheerTix," "we," "us," or "our"). By creating an account, listing an event, purchasing a ticket, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CheerTix provides software that enables cheerleading, dance, and related event producers ("Producers") to list events and sell tickets to attendees ("Buyers"). CheerTix is a technology platform and a limited payment collection agent for Producers. CheerTix is not the seller, organizer, or operator of any event listed on the Service.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for the accuracy of your account information and for all activity that occurs under your account. Keep your password confidential and notify us immediately of any unauthorized use.

3. Tickets, fees, and payments

Ticket prices, taxes, and event details are set by the Producer. CheerTix charges a service fee of $1.50 plus 2% per ticket, which is added at checkout unless the Producer has chosen to absorb the fee. Payments are processed through our third-party payment processor (Stripe). By completing a purchase you authorize CheerTix and Stripe to charge your payment method for the full order total.

4. Refunds, cancellations, and chargebacks

All sales are final unless the Producer's refund policy, displayed on the event page, states otherwise. Refund requests must be directed to the Producer. If an event is cancelled by the Producer, the Producer is responsible for issuing refunds; CheerTix service fees are non-refundable except where required by law. Initiating a chargeback without first attempting to resolve the issue with the Producer is a breach of these Terms and may result in account suspension.

5. Producer obligations

Producers represent and warrant that they have all rights and permissions necessary to host the event, that event listings are accurate and not misleading, and that they will honor every ticket sold. Producers are solely responsible for event delivery, attendee safety, venue compliance, tax collection and remittance, and customer support. Producers agree to indemnify CheerTix from any claim arising out of the event.

6. Acceptable use

You agree not to: (a) use the Service for unlawful, fraudulent, or deceptive purposes; (b) scrape, reverse engineer, or interfere with the Service; (c) resell tickets in violation of applicable law or the Producer's rules; (d) upload content that is defamatory, infringing, or harmful; or (e) attempt to gain unauthorized access to any part of the Service.

7. Intellectual property

CheerTix and its licensors own all rights in the Service, including the CheerTix name, logo, and software. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You retain ownership of content you submit, and you grant CheerTix a worldwide, royalty-free license to host, display, and distribute that content as necessary to operate the Service.

8. SMS and email communications

By providing your phone number and opting in, you agree to receive transactional and event-related SMS messages from CheerTix at the number provided. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. See the Privacy Policy for full SMS details.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. CheerTix does not warrant that the Service will be uninterrupted, secure, or error-free, or that any event will be held as advertised.

10. Limitation of liability

To the maximum extent permitted by law, CheerTix and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Service or any event. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the fees CheerTix received from you in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold CheerTix harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your content, your event, or your violation of these Terms or any law.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may close your account at any time by contacting support@cheertix.com. Sections that by their nature should survive termination will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and CheerTix waive any right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@cheertix.com.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after the effective date of the update constitutes acceptance.
